Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of BLUME, a flower shop management platform operated by Floralpro 2025 Ltd ("we," "our," or "us"), a New Zealand company. By creating an account or using BLUME, you agree to be bound by these Terms.
1. The Service
BLUME is a software-as-a-service (SaaS) platform designed for florists to manage events, clients, flower orders, supplier relationships, quoting, and business operations. Access to BLUME requires a paid subscription.
We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuance.
2. Accounts
You must provide accurate, complete, and current information when creating your account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
You must notify us immediately at admin@blumequote.com if you suspect any unauthorised access to your account.
One account may have multiple team members. You are responsible for ensuring all team members comply with these Terms.
3. Subscriptions & Billing
3.1 Plans
BLUME is offered on a monthly subscription basis. Pricing is shown in NZD, AUD, or USD depending on your location. All prices are exclusive of GST or applicable taxes unless stated otherwise.
3.2 Billing
Subscriptions are billed monthly in advance. Payment is processed by Stripe. By subscribing, you authorise us to charge your payment method on a recurring basis until you cancel.
3.3 Free Trial
Where a free trial is offered, no payment is taken during the trial period. At the end of the trial your subscription will automatically begin unless you cancel before the trial ends.
3.4 Failed Payments
If a payment fails, your account will enter a grace period during which you retain access. If payment is not resolved within that period, access to the service will be restricted until payment is brought up to date.
3.5 Cancellation & Refunds
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. Please see our Refund & Cancellation Policy for full details.
4. Your Data
You retain ownership of all data you upload or create in BLUME (events, clients, orders, files, and other business content). By using BLUME you grant us a limited licence to store, process, and display that data solely for the purpose of providing the service to you.
We will not sell, share, or use your data for advertising. Please see our Privacy Policy for full details on how we handle your data.
You are responsible for ensuring you have the right to upload any data (including client information) and that doing so complies with applicable privacy laws.
5. Third-Party Integrations
BLUME integrates with third-party services including Google Calendar and Xero. By connecting these integrations you agree to the respective third parties' terms of service. We are not responsible for the availability, accuracy, or conduct of third-party services.
You may disconnect any integration at any time from your account settings.
6. Acceptable Use
You agree to use BLUME only for lawful business purposes and in accordance with our Acceptable Use Policy. You must not use BLUME to:
- Violate any applicable law or regulation
- Upload or transmit malicious code or content
- Attempt to gain unauthorised access to any system or data
- Resell, sublicense, or redistribute access to BLUME without our written consent
- Use the service in a way that could damage, disable, or impair our infrastructure
7. Intellectual Property
BLUME and its underlying software, design, trademarks, and content are owned by Floralpro 2025 Ltd. Nothing in these Terms grants you any right to use our intellectual property other than as necessary to use the service.
Any feedback or suggestions you provide may be used by us to improve the service without any obligation to you.
8. Disclaimer of Warranties
BLUME is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.
We make no warranty that BLUME will meet your specific business requirements.
9. Limitation of Liability
To the maximum extent permitted by law, Floralpro 2025 Ltd and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of BLUME, including but not limited to loss of profits, data, or business opportunity.
Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid to us in the three months preceding the claim.
Nothing in these Terms limits liability that cannot be excluded under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 (where applicable).
10. Termination
You may terminate your account at any time by cancelling your subscription and contacting us to request deletion.
We may suspend or terminate your account immediately if you breach these Terms, if required by law, or if continued operation of your account poses a risk to us or other users.
Upon termination, your access to the service will cease. We will retain your data for a reasonable period to allow you to export it before deletion.
11. Governing Law
These Terms are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of the New Zealand courts.
12. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email and update the "Last Updated" date above. Continued use of BLUME after changes take effect constitutes acceptance of the revised Terms.
